General Sale Conditions online purchases on the website

The company Spesasicura Srl with registered and administrative headquarters in Rome, Viale dei Misenati n. 50 share capital Euro 10,000 €, VAT no. 11813211007 (hereinafter "SPESASICURA"), makes available to all users the possibility to purchase via the Internet the products on the site (hereinafter "Products"), through the site (hereinafter "site"), of which it is the sole and exclusive owner.

1) Clarifications

These general conditions of sale ("General Conditions") have been drawn up in accordance with the rules of the Consumer Code (Legislative Decree no. 206/2005), arts. 50-67, and those relating to electronic commerce (Legislative Decree no. 70/2003) and apply exclusively to the sale via the Internet of products that are present on the website. The Customer (hereinafter "customer") is invited to keep, in the preferred manner, these General Conditions. In case of changes to these general conditions, the General Conditions published on the site at the time the order is sent by the customer will always apply.

2) Prices

All prices include VAT. Delivery costs (hereinafter "delivery costs") are charged to the Customer and highlighted in the Purchase Order (hereinafter "purchase order"). The products are sold at the price indicated on the site at the time the order is sent.

3) Purchase Order

Purchase Orders must be made exclusively online. In order to proceed with the compilation of the purchase order, the Customer must first register on the site and follow the following methods: a) In the event that the Customer is already registered on the Site through the appropriate "login" section, it will be sufficient to enter their login credentials (username and password). b) In the event that the Customer is not registered on the site, the same must proceed with the registration by entering the required data in the appropriate form, necessary to be able to proceed with the order and, therefore, the purchase. The purchase contract will be considered concluded upon receipt of the order by SPESASICURA which will give feedback on receipt of the order by sending an e-mail of "order confirmation" to the e-mail address indicated by the Customer during registration. This "order confirmation" will contain the summary of the products chosen with indication of the relative prices (including delivery costs), the delivery address, the order number (hereinafter "order number"). The Customer undertakes to verify the correctness of the data contained in the order confirmation and to communicate by email to SPESASICURA immediately and in any case no later than 12 (twelve) hours from receipt of the same any corrections. Possible increases in expenses caused by errors in the data not reported promptly, will be charged to the Customer. The NdO (Order Number) communicated by SPESASICURA must be used by the Customer in any communication. If calculation errors are ascertained or the presence of discounts not provided for by any promotion in progress, Spesasicura will cancel the order by refunding the payment received. If the products chosen by the Customer are not, in whole or in part, available, SPESASICURA will reverse the value of the undelivered products.

4) Payment methods

Payment is made online in two ways: 1) by PayPal through the Banca Sella system to which the customer will be redirected. 2) by credit card according to the methods indicated on the site and in any case through the Banca Sella system. At the first payment by credit card, Banca Sella sends SPESASICURA an encrypted token to allow the customer to pay the following times without having to reissue all credit card data. Under no circumstances will the Spesasicura systems come into possession of credit card data. The SPESASICURA system will only keep the token with only the last 4 digits of the credit card in clear. Once the payment has been made through the Banca Sella computer system, the Customer will be redirected to the SPESASICURA website and will be charged the amount corresponding to the products purchased with the simultaneous sending of emails confirming the payment. SPESASICURA does not process any personal data, given that payment information is transmitted to Banca Sella. SPESASICURA will issue an order confirmation document for the products purchased, sending it by e-mail to the holder of the Order within 48 (forty-eight) hours from confirmation of payment or attaching it to the package. The order confirmation will be issued using the data and information provided by the Customer and no variation of the same will be possible after the issuance of the same.


4.1) Purchase with Scalapay payment

If you buy with Scalapay you receive your order and pay in 3 installments. You acknowledge that the installments will be transferred to Incremento SPV S.r.l., to related parties and their assignees, and that it authorizes such sale.

5) Delivery Methods

SPESASICURA will deliver the products purchased through specialized carriers (hereinafter "Carriers"). At the time of delivery, the presence of the Customer or a trusted person is required to check that the packaging is intact and clean and that the products received correspond to what is reported on the order. In case of visible defects of the package, damage, crushing or loss of liquids from the package itself, the Customer or the person in charge of his trust must provide for the relative reporting on the transport document and promptly contact SPESASICURA by email or telephone no later than 7 (seven) days from delivery. The delivery service will be carried out by express courier for which we can also provide you with tracking numbers. The order is shipped on the first working day following that of the issuance of the same. SPESASICURA delivers the purchased products to the address indicated by the Customer approximately within 48/72 hours of departure. This timing is only indicative, therefore no responsibility can be attributed to SPESASICURA in case of failure to comply with it. Delivery will be made by courier between 8.00 and 19.00 from Monday to Friday. If the Customer has requested the "telephone notice" service, the Customer will be contacted directly by the Carrier to give notice of the time slot and the day on which the Delivery will be made. When telephone notice is required, delivery may take an extra day. SPESASICURA delivers throughout Italy including smaller islands for which there is an increase for disadvantaged areas provided by all national couriers.

6) Delivery Costs

Delivery costs are charged to the Customer and adequately indicated in the order.

The Customer may have information about after-sales assistance services by contacting SPESASICURA using the contact details indicated in the "Contacts" section of the site.

8) Right of withdrawal

If the Customer qualifies as a "consumer", pursuant to Article 3 of the Consumer Code, the same has the rights referred to in art. 64 of the Consumer Code and therefore the right to withdraw from the contract ("right of withdrawal") for any reason, without explanation and without any penalty, in the manner specified below. The withdrawal may concern all (total withdrawal) or only part of the products purchased by the consumer (partial withdrawal). The right of withdrawal is exercised by sending - within 14 (fourteen) working days from the date of receipt of the products - a communication by registered letter with return receipt addressed to: SPESASICURA SRL viale dei Misenati 50 Rome The communication can be anticipated - within the same term - by e-mail to the address provided that it is confirmed by registered letter with return receipt, within the following 48 (forty-eight) hours. The notice of withdrawal must specify the intention to withdraw from the purchase and the product or products for which you intend to exercise the right of withdrawal, attaching a copy of the purchase document. In the communication, the customer must also confirm that the product(s) is intact and stored in perfect condition in its original packaging, complete in all its parts. Within the site you can download a pre-filled form to be used for the notice of withdrawal. Following the correct exercise of the right of withdrawal, SPESASICURA will forward the file number to the Customer via email. This number must be indicated by the Customer when returning the product (s). The return of the product (s) must take place within 14 (fourteen) calendar days from the date of receipt of the same. The right of withdrawal is however subject to the following conditions: • the right applies to individual products purchased in their entirety; • the product(s) purchased must be intact and returned in its original packaging, complete in all its parts (including packaging and accessory documentation); • the transport costs related to the return of the product are charged to the Customer; • the return is under the full responsibility of the Customer. If the right of withdrawal has been correctly exercised, SPESASICURA will refund the Customer the full amount already paid, including delivery costs, within 30 (thirty) calendar days from receipt of the notice of withdrawal. The amount refunded will be net of the costs for returning the products, which will be charged to the Customer. In the event that the customer refuses the delivery of a package already entrusted to the courier, the customer is still required to pay the shipping costs and return to the warehouse of each rejected shipment; In the event that the shipment has not yet been entrusted to the courier nothing will be charged to the customer.

9) Warranties

a) Legal guarantee for the consumer The Consumer, as defined in art. 3 of the Consumer Code (Legislative Decree 6 September 2005, n. 206), has the right to make use of the legal guarantee provided by the Consumer Code itself in articles 128 to 132. This guarantee provides, among other things, that the consumer, under penalty of forfeiture, reports to SPESASICURA any lack of conformity found by the consumer in the product purchased within 2 (two) months of discovery (Article 130 of the Consumer Code). Following this complaint, the consumer will have the right to restore, without charge, the conformity of the goods by repair or replacement of the product, without prejudice to the other rights provided by law in favor of the Consumer. The above Legal Guarantee is valid for a maximum period of 2 (two) years from the Delivery of the Product. Beyond this term, SPESASICURA, therefore, will not be responsible for the lack of conformity found by the consumer. In case of replacement or repair of the Product, the terms of the warranty relating to the Product given in replacement or resulting from the repair, are the same as the original product. Therefore, the total two-year duration of the legal guarantee will in any case start from the delivery of the original product. In order to take advantage of the warranty it is necessary to show the purchase document. In any case, for the regulation of the legal guarantee, reference is made to the rules of the Consumer Code referred to in articles 128 and following. b) Legal guarantee for non-Consumer Customers The non-consumer Customer, as defined in art. 3 of the Consumer Code, has the right to make use of the legal guarantee provided for in the Civil Code. This guarantee provides, among other things, that the non-consumer Customer, under penalty of forfeiture, reports to SPESASICURA any lack of conformity found in the product purchased within 8 (eight) days of discovery. The above legal guarantee is valid for a maximum period of 12 (twelve) months from delivery of the product. Beyond this term, SPESASICURA will not be responsible for the lack of conformity found by the non-consumer Customer. In order to take advantage of the warranty it is necessary to show the purchase document.

The Customer's data are processed by SPESASICURA in accordance with the provisions of the legislation on the protection of personal data, as specified in the information provided in the "Privacy Policy" section on the site at the link:

12) Place of jurisdiction

Any disputes related to the interpretation or execution of this contract will be resolved exclusively by the Court of Rome, without prejudice to the application of the rules of the Consumer Code in the case of purchases by Consumers.
